1. Acceptance of Terms

Welcome to Wavekay. These Terms of Service ("Terms") govern your access to and use of the Wavekay online store, located at wavekay.myshopify.com (the "Site"), and the purchase of products and services offered through the Site. By accessing, browsing, or making a purchase on the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, Return Policy, and all other policies referenced herein. If you do not agree to these Terms, you must immediately cease using the Site and refrain from placing any orders.

These Terms constitute a legally binding agreement between you ("you," "your," or "Customer") and Wavekay ("we," "us," "our," or "the Company"). We reserve the right to update, modify, or replace any part of these Terms at any time. It is your responsibility to review these Terms periodically for changes. Your continued use of the Site following the posting of any changes constitutes acceptance of those changes.

2. Eligibility

By using the Site and placing orders, you represent and warrant that:

  • You are at least 18 years of age or the age of majority in your state or jurisdiction of residence, whichever is older;
  • You have the legal capacity and authority to enter into a binding contract;
  • If you are using the Site on behalf of a business or other legal entity, you have the authority to bind that entity to these Terms;
  • You are not located in a country subject to a United States government embargo or designated by the United States government as a "terrorist supporting" country;
  • You are not listed on any United States government list of prohibited or restricted parties;
  • All information you provide to us is truthful, accurate, current, and complete;
  • You will comply with all applicable federal, state, and local laws and regulations in connection with your use of the Site and purchase of products.

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion, including if we believe you have violated these Terms or engaged in fraudulent, abusive, or illegal conduct.

3. The Store and Products

Wavekay offers a curated selection of products for sale through the Site. We make reasonable efforts to display our products accurately, including descriptions, specifications, dimensions, colors, features, materials, images, and other attributes. However, we do not warrant that product descriptions, images, pricing, or other content on the Site is accurate, complete, reliable, current, or error-free. The colors and images you see will depend on your monitor and device settings, and we cannot guarantee that your device will accurately display such colors or details.

We reserve the right at any time to:

  • Modify, discontinue, or update any product or service without prior notice;
  • Limit the quantities of any products or services we offer;
  • Impose conditions on the honoring of any coupon, discount, promotion, or offer;
  • Bar any user from making a purchase;
  • Refuse or limit any order, including orders that appear to be placed by dealers, resellers, or distributors.

Product availability is subject to change without notice. If a product you have ordered becomes unavailable, we will notify you and provide a full refund or offer a substitute product of equal or greater value, at your option.

4. Orders and Order Acceptance

When you place an order through the Site, you are making an offer to purchase the products in your cart subject to these Terms. All orders are subject to acceptance by Wavekay. We may, in our sole discretion, refuse or cancel any order for any reason, including but not limited to:

  • Product or service availability;
  • Errors in product or pricing information;
  • Errors in your order;
  • Suspected fraud, unauthorized or illegal transaction;
  • Failure of payment authorization;
  • Inaccurate or incomplete customer information;
  • Shipping restrictions or inability to ship to your location;
  • Limitations we have imposed on quantities available for purchase;
  • Any other reason in our sole discretion.

Your receipt of an order confirmation or shipping notification does not constitute our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right to cancel any order after it has been placed, including after you have received a confirmation email. If we cancel your order after payment has been processed, we will issue a full refund to your original method of payment.

Once an order has been placed, you may request cancellation by contacting us immediately at content@wavekay.shop or 8056765492. We will make reasonable efforts to accommodate cancellation requests, but we cannot guarantee cancellation if the order has already been processed or shipped.

5. Pricing and Sales Tax

All prices displayed on the Site are in United States Dollars (USD) and are exclusive of sales tax. Prices are subject to change at any time without prior notice. We make every effort to ensure that pricing information is accurate; however, pricing errors may occur. If we discover a pricing error after you have placed an order, we will notify you and give you the option to cancel the order or proceed at the correct price.

Sales Tax: Applicable state and local sales taxes will be calculated and added to your order total at checkout based on the shipping destination address. The amount of sales tax charged will depend on several factors, including the products purchased and the destination to which the products are shipped. You are responsible for payment of all applicable taxes.

We reserve the right to revise pricing and correct errors even after an order has been submitted and whether or not the order has been confirmed and your payment method charged. If the correct price is higher than the stated price and we decide to proceed with the order, we will contact you for instructions before processing the order. If the correct price is lower, we will charge the lower amount and ship the product to you.

6. Payment

Payment is due in full at the time you place your order. We accept major credit cards, debit cards, and such other payment methods as may be made available through the Site from time to time. By providing payment information, you represent and warrant that:

  • You are legally authorized to use the payment method provided;
  • The payment information you provide is true, correct, and complete;
  • Charges incurred by you will be honored by your payment method provider;
  • You will pay the charges incurred by you at the posted prices, including all applicable taxes.

You authorize us to charge the payment method you provide for the total amount of your order, including the purchase price, applicable sales tax, and any other fees or charges. We use third-party payment processors to process payments securely. We do not store complete credit or debit card information on our servers.

If your payment method is declined or if payment cannot be verified or processed for any reason, we reserve the right to cancel your order. You agree to pay all costs of collection, including reasonable attorneys' fees and costs, if we must take action to collect amounts you owe.

7. Shipping and Delivery

We currently ship to addresses within the United States. Shipping within the United States is FREE — there are no shipping costs or additional delivery charges for domestic orders. Orders are generally processed within approximately 1 to 2 business days following successful payment confirmation. Estimated delivery time is 3 to 5 business days from the date of shipment to eligible destinations within the United States.

Please note that delivery estimates are approximate and are not guaranteed. Actual delivery times may vary due to factors beyond our reasonable control, including but not limited to:

  • Shipping carrier delays;
  • Weather conditions;
  • Natural disasters or other force majeure events;
  • Transportation interruptions;
  • Public holidays;
  • Customs clearance procedures (if applicable);
  • Inaccurate or incomplete shipping address information;
  • Failed delivery attempts;
  • Operational disruptions.

All shipping and delivery times exclude weekends and public holidays. Title and risk of loss for products pass to you upon delivery to the shipping carrier. You are responsible for providing a complete and accurate shipping address. We are not responsible for orders shipped to incorrect, incomplete, or outdated addresses provided by you.

8. Returns and Refunds

We want you to be satisfied with your purchase. If you are not completely satisfied, you may return eligible products within 30 days after delivery in accordance with our Return and Refund Policy. Please note that there is no statutory "cooling-off period" or right of withdrawal for online purchases in the United States; our 30-day return window is our own voluntary policy designed to ensure customer satisfaction.

To be eligible for a return, products must be unused, in their original condition, and in the original packaging. Certain products may not be eligible for return due to hygiene, safety, or other reasons, as specified in our Return and Refund Policy. Please review that policy carefully before initiating a return.

Refunds, if approved, will be processed to your original method of payment within a reasonable time after we receive and inspect the returned product. We reserve the right to refuse returns that do not comply with our Return and Refund Policy or to impose restocking fees, deduct shipping costs, or take other actions as permitted by law and described in that policy.

9. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, images, photographs, audio clips, video clips, data compilations, software, design elements, trade names, trademarks, service marks, and the compilation and organization thereof (collectively, "Content"), is the property of Wavekay or our licensors and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

The Wavekay name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Wavekay or our affiliates or licensors. You may not use such marks without our prior written permission. Other names, logos, product and service names, designs, and slogans mentioned on the Site may be the trademarks of their respective owners.

You are granted a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Site and Content solely for your personal, non-commercial use in connection with browsing and purchasing products. You may not:

  • Reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any Content, except as incidental to normal web browsing or as expressly permitted in these Terms;
  • Use any Content for commercial purposes or for any public display (commercial or non-commercial);
  • Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices from Content;

10. Acceptable Use

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site:

  • To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation;
  • To impersonate or attempt to impersonate Wavekay, a Wavekay employee, another user, or any other person or entity;
  • To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site, or which, as determined by us, may harm Wavekay or users of the Site or expose them to liability;
  • To use the Site in any manner that could disable, overburden, damage, or impair the Site or interfere with any other party's use of the Site;
  • To use any robot, spider, or other automatic device, process, or means to access the Site for any purpose, including monitoring or copying any of the material on the Site;
  • To introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful;
  • To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site;
  • To attack the Site via a denial-of-service attack or a distributed denial-of-service attack;
  • To otherwise attempt to interfere with the proper working of the Site.

We reserve the right to terminate or suspend your access to the Site immediately, without prior notice or liability, if you breach these acceptable use provisions or any other provision of these Terms.

11. Disclaimers of Warranties

YOUR USE OF THE SITE, PRODUCTS, SERVICES, AND CONTENT IS AT YOUR OWN RISK. THE SITE, PRODUCTS, SERVICES, AND CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WAVEKAY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THOSE ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WAVEKAY DOES NOT WARRANT THAT:

  • THE SITE, PRODUCTS, SERVICES, OR CONTENT WILL MEET YOUR REQUIREMENTS;
  • THE SITE WILL BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION, UNINTERRUPTED, SECURE, OR ERROR-FREE;
  • ANY DEFECTS OR ERRORS WILL BE CORRECTED;
  • THE SITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM WAVEKAY OR THROUGH THE SITE WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the limitations in this section and in the Limitation of Liability section below may not apply to you. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.
